HC restrains college from using similar domain name
CHENNAI: The Madras high court has granted an interim injunction restraining Amirta International Institute of Hotel Management in Coimbatiore and Trichy from using any domain name similar to ‘Chennai Amirta.’
Proprietor of Chennai Amirta International Institute of Hotel Management, B Uma Maheswari, said Amirta International Institute of Hotel management, at Coimbatore and Trichy, represented by its CEO R Suresh Kumar, and partners S Manimegalai and M L Satish Kumar, is using web domain name which is deceptively similar to the Chennai based institute’s trade/domain name.
The court passed an order restraining the Coimbatore based institute from using the domain names , , www.chennaiamirta.org, or any other trade name which infringed the trademark of Chennai Amirta International Institute of Hotel Management.
Justice K Ravichandrabaabu granted an interim injunction till July 24 directing the CEO, partners, directors, employees, agents and any other people acting on behalf of Amirta International Institute of Hotel Management not to use any trade mark which was similar to the trademark ‘Chennai Amirta.’ The matter was posted to July 24 for further hearing.
“The Hotel management institution, operating from Coimbatore and Trichy, had purchased the web-domains in the names of ‘Chennai Amirta’. When information seekers, typed or clicked ‘Chennai Amirta’ they were getting misdirected to the website of ‘Amirta International Institute of Hotel management institution’. After the interim injunction, the general public and the students will not be misled and can act without any confusion. ‘Chennai Amirta’ is about to claim the huge loss that has been incurred due to this activity from the above mentioned three individuals,” said a release from ‘Chennai Amirta’.
